1. Acceptance
By accessing the Enfacial website or using any Enfacial application (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. The Service
Enfacial provides face-powered payment infrastructure to institutions. End users access the Service through an institution that has entered into a separate agreement with Enfacial. Operators and administrators access the Service on behalf of that institution.
3. Your account
- You must provide accurate information and keep it current.
- You are responsible for activity on your account and for keeping your credentials confidential.
- The institution may suspend or close accounts that violate its policies or these Terms.
4. Acceptable use
You agree not to:
- Attempt to bypass authentication or spending controls.
- Enrol another person’s face without their consent.
- Reverse-engineer, decompile, or otherwise attempt to extract source code or model weights.
- Use the Service in a manner that violates applicable law or infringes another party’s rights.
5. Payments
Enfacial is not a payment aggregator and does not hold funds. Wallet top-ups and vendor settlements are processed through regulated payment partners directly into the institution’s own accounts. Transaction disputes are handled by the institution in accordance with its own policies and applicable law.
6. Intellectual property
Enfacial and its licensors retain all right, title and interest in the Service, including all software, models, designs and trademarks. No rights are granted except those expressly set out in these Terms.
7. Data
Our handling of personal and biometric data is described in our Privacy Policy, which is incorporated by reference into these Terms.
8. Warranty disclaimer
The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Enfacial will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill.
10. Indemnity
You will defend and indemnify Enfacial against any third-party claim arising from your breach of these Terms or misuse of the Service.
11. Termination
We may suspend or terminate access if you breach these Terms or if required by law. You may stop using the Service at any time.
12. Governing law
These Terms are governed by the laws of the institution’s jurisdiction under the separate agreement between Enfacial and the institution. For general website use outside an institutional deployment, the laws applicable to Enfacial’s principal place of business apply.
13. Changes
We may update these Terms. Material changes will be communicated through the Service or on this page.
